Parents empowered by Supreme Court ruling in special ed case

Craig Ferguson | 31 March, 2017, 02:09

Dick Durbin about a book he wrote on assisted suicide, which touched on the debate over when life begins. In the opinion of Gorsuch and his 10th U.S. Circuit Court of Appeals colleagues, that bar is incredibly low.

"Do you accept that?"

"I accept the law of the land, senator, yes", Gorsuch answered.

"That's not what judges do", he continued.

"The IDEA demands more", the chief justice said.

Gorsuch agreed he would face being removed and that litigants could question his fairness if that issue were to come before him in court.

On Eisenstadt v Baird, which established the right of unmarried people to possess contraceptives, Gorsuch said, "To say I agree or disagree with the United States Supreme Court as a judge is an act of hubris". "I speak for myself".

Following this decision, the impetus will be on public schools to adjust their standards and goals for students accordingly.

The federal Individuals With Disabilities Education Act (IDEA) guarantees a "Free Appropriate Public Education" to all students with disabilities. Jacob Howard - the two lawmakers credited with writing the language that has been cited in more Supreme Court cases than anything else in the Constitution. On Tuesday, Sen. Dick Durbin of IL asked Gorsuch about a letter from one of his former students, alleging that Gorsuch once suggested that many professional women manipulate their companies for maternity leave benefits.

Gorsuch noted there was a circuit split on the standard and argued he was trying to follow precedent as best he could. "And I can tell you that we were doing it unanimously in all of those cases".

Gorsuch said he finds it "wonderfully reaffirming" that there's a body like the Supreme Court that resolves situations like these in which federal courts disagree. Patrick Leahy, D-Vt., on legal concepts Trump's critics have accused the president of violating.

Gorsuch replied that he never made such an insinuation.

Pressed by Blumenthal to give an opinion on the case, Gorsuch demurred. "If I thought that were true, I'd hang up the robe".

FARGO-The Republican National Committee is embarking on a large digital advertising campaign to put pressure on Senate Democrats in targeted states, including Sen.

"That's the rule of law in this country", Gorsuch said. Lower courts had ruled that programs with only minimal benefits met the law's requirements.

The Court then returned the case to the Court of Appeals to reassess the parents' claims under the correct standard.

"Judge Gorsuch felt that an education for my son that was even one small step above insignificant was acceptable", said Perkins. Ben Sasse, R-Nebraska, called it "absurd".

"We're here today under very unusual circumstances", she said.

Gorsuch's nomination comes after Republicans successfully blocked President Barack Obama's Supreme Court pick, Merrick Garland, from being considered to fill the void left by late Justice Antonin Scalia, who died in February of 2016.

As a father adversely affected by one of Gorsuch's scrutinized rulings, Perkins was already lined up as a witness by Democratic members of the Judiciary Committee. If he passes that vote - which he is expected to do - the full Senate will vote on him soon afterward.
