Mathers was Playmate of the Year in 2015, and she is arguably an example of classic beauty-she is thin, has a symmetrical face, and has long blonde hair.

The 29-year-old Mathers faced widespread criticism after she shared the photo on Snapchat in July 2016 with the caption: "If I can't unsee this then you can't either".

Judge Gustavo Sztraicher disagreed and scheduled her trial for 26 May, the New York Daily News reports.

The defense unsuccessfully tried to get the case thrown out on the theory the law was vague about how "identifiable" a victim needs to be.

In February, the Los Angeles City Attorney's office scoffed at Mathers' request to have her sentence deferred, stating that Mathers "does not qualify nor merit such leniency".

She has now been charged with misdemeanour invasion of privacy.

California law dictates that it's illegal to photograph or film an "identifiable person" in a changing room, a tanning booth or in their home without consent. Meanwhile, Mathers apologized on social media, explaining that she hadn't meant to post the Snap publicly, that she was "absolutely wrong".

Mathers, who has no criminal record, has offered to make amends by using her notoriety to bring attention to the issue of body shaming.

The offence comes with a $1,000 and six months in jail as a potential punishment.

After a lengthy hiatus from social media, Mathers returned to Instagram and Twitter this month, and vehemently denied ever body shaming anyone. That is not the type of person I am'.

At the time, the attorney of the 70-year-old woman said "body-shaming is humiliating, with often painful, long-term consequences". "It mocks and stigmatizes its victims, tearing down self-respect and perpetuating the harmful idea that our unique physical appearances should be compared to air-brushed notions of 'perfect'".
