The judge was speaking as he oversaw the latest round of a legal fight between Charlie's parents and Great Ormond Street bosses at a High Court hearing in London.

It is unknown whether the parents of Charlie Gard are planning to continue their legal battle for his life if the High Court and Mr. Justice Francis once again deny their request to bring him to the United States for treatment.

"If there is important new evidence that suggests my decision should be changed then I will change it", he said.

But he insisted the new evidence must be significant for him to reopen the case. Because of the laws under the Britsh National Health Service, Charlie's parents are not allowed to take their son to other doctors unless the hospital doctors give permission. His parents Chris and Connie have raised over $1.7 million in the hopes of bringing their son to the USA for experimental treatments in hopes of saving his life. The judge adjourned proceedings for lunch shortly afterwards and Charlie's parents returned to court for the afternoon session.

The court heard Ms Yates had measured her baby's head this morning and there was a 2cm difference with the hospital's measurements.

Putting forward new evidence, the unnamed witness said that since April they have evaluated more data, and estimated the chance of success to be at least 10 per cent, referencing that of nine patients on ventilators, one is off and breathing independently.

Charlie's doctors do not believe his condition can be improved with the treatment.

Charlie's mother responded to the testimony with a thumbs up.

The 11-month-old is said to be in the "terminal stages" of a rare condition called mitochondrial DNA depletion syndrome, and has brain damage, but his mum and dad are adamant that he can make a recovery in the right hands.

In a preliminary hearing on Monday, Francis said he would consider any new evidence and announced the hearing for today in the Family Division of the High Court.
