The Labor Department says KMG, the manufacturer of the Fireball, is expected to have rides at this year's N.C. State Fair, though there is a temporary ban on the Fireball. Almost two weeks later, the cause of the accident was revealed.

Tyler Jerrell, 18, was pronounced dead on the scene after being thrown 50 feet.

Four of the injured remained hospitalized last week, including an 18-year-old woman in a coma, and Jarrell's 18-year-old girlfriend. Lewis is in serious condition.

This led to the ride's "catastrophic failure" - AKA spinning out of control and shooting people into the air. Jarrell had recently enlisted with the U.S. Marine Corps and was supposed to attend basic training next year.

The family of the man who was killed is pursuing a wrongful death lawsuit in connection with the accident. The fair's last day was Sunday.

"KMG has reviewed the results of the inspection and worked with industry safety experts to develop an inspection protocol.to allow properly inspected and maintained rides to safely reopen", the company said.

A co-owner of the company that provides rides at the fair in Columbus has said he's certain the ride fell apart because of a mechanical problem.
