Transgender service members sue Trump over military ban

LGBT group is preparing to sue the Trump administration over transgender ban LGBT Rights Group Vows To Sue Trump Over 'Shameful' Trans Military Ban

The lawsuit, Jane Doe v. Trump, asks the court to prevent the Trump administration from enforcing the ban, saying a reinstatement of the ban against transgender people violates the US constitutional guarantees of equal protection of the law and due process.

"After consultation with my generals and military experts, please be advised that the United States government will not accept or allow transgender individuals to serve in any capacity in the USA military", Trump tweeted.

The case, known asDoe v. Trump, seeks to stop the Trump administration from implementing the proposed policy change, which would thousands of transgender troops estimated to be actively serving in the USA military. The gathering recorded the claim alongside the National Center for Lesbian Rights.

The National Center for Lesbian Rights and GLBTQ Legal Advocates filed a lawsuit on behalf of five active trans service members in the U.S. District Court in the District of Columbia on Wednesday.

Five active duty transgender service members have sued Donald Trump and members of his administration, asserting that the US President's ban on transgender military service is unconstitutional.

A spokesman for the Defense Department declined to comment on the lawsuit, saying only that they were working with the White House to develop a written policy. This includes the June 2016 decision by the Department of Defense allowing them to serve openly. While such a ban has not yet gone into effect, the lawsuit explains this guidance from the commander-in-chief has already harmed transgender people who are in the military by taking away their "reasonable expectation of continued service".

"Last year, the Department of Defense announced that transgender people could serve openly", said one plaintiff.

The members say they have already told their commanding officers about being transgender and have already started treatment to change gender.

"My experience has been positive and I am prouder than ever to continue to serve", one of the plaintiffs said in a statement released by her lawyers. "These servicemembers, like many others, have built their lives around their military service".

"If President Trump is truly concerned about the financial costs of transgender service his announced ban has it exactly backwards". Among them were both Outserve and Lambda, which have said they were recruiting plaintiffs for a joint lawsuit when the matter is ripe, a legal term meaning the facts of a case have developed enough for a decision. In a lawsuit naming Trump, Defense Secretary Mattis, and other heads of the USA military, the lawsuit cites the Fifth Amendment and states the ban is unconstitutional. To date, there has been no guidance from the White House.

About 15,000 transgender people are now serving in the military, according to an estimate from The Williams Institute at UCLA.

Experts say the military spends approximately $8 million on medical costs for transgender service people, according to The Atlantic. A ban on transgender service persisted through medical regulation began in the 1980s and through seven-and-a-half years of the Obama administration before former Defense Secretary Ashton Carter changed the policy.
