Dallas Cowboys running back Ezekiel Elliott's hearing with the Second Circuit Court of Appeals is scheduled for Thursday afternoon.

Elliott told reporters that he hasn't ever considered accepting his suspension because "it's bigger than football."

None of the judges assigned to Elliott's case presided over the NFL's winning appeal in Patriots quarterback Tom Brady's four-game suspension in the Deflategate case.

Elliott has repeatedly denied that he assaulted his then-girlfriend, although his comments from the team's training facility in Frisco, Tex., were among his most forceful on the subject.

NFL commissioner Roger Goodell suspended Elliott for six games on August 11 after a 13-month investigation concluded he was in violation of the league's personal-conduct policy for the incident in the summer of 2016. Elliott was not charged by prosecutors for an alleged assault reported to police in Columbus, Ohio, in July 2016.

The 2nd U.S. Circuit Court of Appeals on Friday issued an emergency stay of the NFL's punishment, the third legal reprieve for Elliott.

In the WMSC interview above, we discussed the Judge Failia ruling that shocked those following Elliott's story and made it likely that he would not play for the next six games starting Sunday. Elliott and the NFLPA want judges to grant them a preliminary injunction.

"When we started game planning, we didn't think he would be available to us", Cowboys coach Jason Garrett said. Unlike last week, Elliott will get to practice since he's not now suspended.
